To sublet is to rent out all or part of a space you are renting yourself to another person, so that they use it and usually pay you for it, while you stay responsible to the owner.

Our terms don't use the word "sublet", but three clauses rule it out:

  • "You may not assign or transfer any of Your rights under this Agreement or part with possession of the Unit or Goods whilst they are in the Facility" (clause 46(i));
  • you're licensed to store goods "only in that Unit", and you warrant that you own the goods or are entitled to deal with them "as agent for the owner" (clause 1);
  • you must use the unit "solely for the purpose of storage" (clause 22).

So you can't rent your unit, or a corner of it, to someone else, and you can't hand the agreement over to a new person.

Sharing access is not subletting

You can let other people into your unit. Clause 14 says "Only You or Your Agents may access the Unit", and an Agent is someone you authorise or who comes with you. The difference is who is in charge: an Agent acts for you, and you stay "responsible for and liable to Us and other users of the Facility for Your own actions and those of Your Agents". Clause 16 adds that if you give a key or access to anyone other than your own Agent, "it is at Your own risk."

If someone else needs to take over storage for good, ask us about setting up an agreement in their name, and about the timing, so their goods aren't left without a unit.

Storing someone else's belongings

This is different from subletting: the unit stays yours and nobody pays you for space. Under clause 1(c) you "warrant that You are the owner of the Goods in the Unit and/or entitled at law to deal with them in accordance with all aspects of this Agreement as agent for the owner." So you can store a relative's or a friend's things if you're entitled to deal with them for the owner, and every rule in the agreement, including insurance and the lien, then applies to those goods.
