Change to terms or fees

A change to terms or fees is when a business alters the price or the conditions of an agreement that's already running. In an ongoing agreement with no end date, the contract itself usually sets out how much notice you get and what you can do if you don't accept the change.

Clause 45 of our terms governs it:

"We may vary the Storage Fee or other terms of this Agreement and add new terms and conditions as long as such changes are notified to You in writing. The modified terms will take effect on the first Due Date occurring not less than 28 days after the date of Our notice. You may end this Agreement without charge before the change takes effect by giving notice in accordance with Clause 39. Otherwise, Your continued use of the Unit will be considered as Your acceptance of and agreement to the amended terms."

So a price rise can't take effect sooner than the first payment date at least 28 days after our notice, and you can leave before then without charge. Staying on counts as accepting it.

Notices about "changing prices" and other significant changes come in writing, by hand, post or email (clause 39). Smaller day-to-day changes can be sent by email, or by text message if you've agreed to receive notifications that way (clause 38).

What to do when you get a notice

Check the new figure and the date it starts. If you decide to leave, clause 45 says you "may end this Agreement without charge before the change takes effect by giving notice in accordance with Clause 39." Clause 39 sets how notice is given (in writing, by hand, post or email). Clause 45 doesn't say whether the usual notice period on your Cover Sheet still applies in this case, so if you're planning to leave because of a change, ask us to confirm your end date in writing. If you're staying, you needn't do anything.

Keep your email and postal address up to date with us, because the terms treat a notice sent to the address you last gave us as received one day after it's emailed, or 48 hours after it's posted (clause 39).
